I. MENTAL FITNESS FOR THE OFFICE OF PRESIDENT

According to the articles [Article III on the rules governing the questions of legitimacy or criminality of the sitting President, Donald J. Trump] our chief executive has made a direct plan of constitutional insubordination. He has made his actions an overt demonstration that his ‘belief ‘is above the law. He has rationalized his dictatorial powers with a stream of falsehoods, false accusations, false fact checking, lost memory, and big–lie exaggerations which have created a psychological diagnosis of his mental incompetency. President Trump is not mentally fit for the decision-making rigors of the Nuclear Presidency in the modern age.¹

My fear is that for the next four years, America will be watching a man experience what the clinical language calls narcissistic injury. I predict the presidency is going to be torture for him. He will be subject to the scathing criticism that all politicians must endure. And we already have seen how agitated he becomes in the face of even mild rebukes or disappointing facts about the crowd size at his inauguration. Imagine how Trump will respond to the inevitable failures, frustrations, and setbacks. (For this reason, the thought of him being just another human being suffering from mental health issues that are out of his control or even awareness causes me to have some degree of compassion for him—as odd as that may sound.) All of the narcissistic injury he endures will cascade to the emotional hostages he has assembled in his orbit… They obey one imperative only: do what is necessary to avoid the crash and burn. I have seen it all too often in my professional practice. And now I am witnessing it in man who may already have taken a whole country as his emotional hostage. ² Psychotherapist Felix Vikhman

Article II concerning the Chief Executive’s ‘fitness to serve’, does provide for this “inability to discharge the powers and duties of the said office.” But is not equiped to guide this crisis of confidence through the 21^st century’s timing of instantaneous Nuclear Military power having crucial decisions of War and Peace reside with the Chief Executive day and night in an incapacitated state, either mentally or physically. I purpose a new Article with Amendments to take into account all possible contingencies for rational control of these crises and to end the “single person” exterminating power in our present nuclear weaponry control confusion.

It’s hard to know what to expect under a Trump presidency, but as Chomsky said, “to have somebody who’s kind of a wild man with his finger on the button that could destroy the world or make decisions with enormous influence is an extremely frightening prospect.”

II. CORRUPTION IN HIGH OFFICE

Being the commander in chief of the U.S. nuclear armada [army, navy, and militia – all nuclearized for extinguishing resistance in service of the chief executive’s protective discretion] section 4 of the Article III provides “removal from office on Impeachment for, and conviction of Treason [which is demonstrated by Trump’s relationship with V. Putin of the Russian Federation]; Bribery [his divestiture of proprieties; hidden financial holdings in his refusal to divulge tax reports for scrutiny on his financial holdings world-wide; a full accounting of foreign and domestic loans and possible conflicts of interest; and other High Crimes and Misdemeanors in his corruption of the U.S. Court system of Laws and precedents for personal gain.] These are signs of Trumpian style corruption in high office.

III. HIGH CRIMES

High crimes are a feature of the Trumpian way and political philosophy [his disregard for the governing philosophy blueprinted in the 1789 document of the founding fathers]. Trump is a criminal personality in flagrant misuse of the structural power invested in the laws of the republic. His behavior as the chief executive law officer³ is diametrically opposed to the Constitution’s framework for a Chief Executive Officer.

1) Trump is already exhibiting a penchant for War Crimes against other nation states.

Article I, section 8 enumerates “offenses against the Law of Nations” as a offense against the morality codes of the Constitution. This would be evidence of war crimes in times of foreign disputes and the use of excessive violence against combatants and suspected innocent women and children. He has advocated the resumption of torture renditions, waterboarding, not defining “extreme vetting of refugees” and cruel and inhumane methods of military interrogation. These actions all against the International prohibitions [Geneva Conventions; Treaty Obligations for peaceful means of resolving disputes; U.N. Sanctions; Amnesty International, and the World Court decrees]

2) Trump’s incompetent actions under the law, [he is bond to by his inauguration oath of office] displays a total disrespect for the present form of constitutional government. Most egregious is his continuing verbal assaults on the Judiciary; from lower Courts to Supreme Court he has characterized this co-equal Branch of Government as “politically biased”⁴. This is being accomplished in incremental steps by Trump’s philosophy of intimidation [through press briefings, private tweeter inflammatory rhetoric, fake facts as truth to be followed without

“question”] foretelling a future Trump dictatorship rife with serious consequences for the cherished ideals fought and died for [“…give me liberty or give me death.” – Patrick Henry] in the sacrifices of our courageous ancient intellectual leaders. Trump’s narcissistic one-dimensional thinking is leading the country to a dissolution of the Union to be replaced by a Confederacy under the dictator Trump as its’ Imperial Ruler. In regard to the imposition of a new Confederacy, the Constitution is quite clear in Article I, section 8 and the 2^nd Amendment with the right to bear arms empowerment intended to put down insurrections and rebellions against the Union using a call to ‘arms’ individual citizen army, called a Militia, to be mustered in each state.

To provide for …the Militia to execute the Laws of the Union,

Suppress Insurrections and repel invasions [refer to Bill of Rights

2^nd Amendment and U.S. Constitution, Article I, section 10]

To provide for the organizing, arming, and disciplining, the Militia

…Part of them as may be employed in the Service of the United

States [Militia Federalizing]…

This demonstrates the hated condition embittering our founders thinking and their motivating vision of despised “divine kings” which they had experienced as citizens of the European nation-states of that era. These concerns gave them a strong motive to suffer the difficult ocean crossing and escape oppressive tyrannical regimes.

The colonists’ embittered governmental philosophy was rooted in their reaction to the institutional inhumanity, worker degradations, religious intolerance, and accepted morality of enslavement imposed by those corrupted nobilities. And so, the United States still stands as the bold and humane experiment it purports to be, receiving its’ sustaining power from documents [Declaration of Independence and U.S. Constitution] fashioned by American writers of ’genius’; for recognition of tyranny and the ‘enlightened’ rules for civil humane discourse to effect a “tranquil” organization of people living in an immense tract of land.

Donald J. Trump is the mob’s fearful flaming torch lit to extinguish this fragile humane experiment. He is its’ “chief anarchist” and Gabriel’s shrieking Trumpet call at the Walls of Jericho, clarifying our warning of the dreaded return to an oppressive ‘kingly’ Tyranny.

IV. TRUMPSPEAK – ANTI-FIRST AMENDMENT RHETORIC

Amendment I

Freedom of religion, speech, and the press; rights of assembly and petition

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or the press; or the right of the people peaceably to assemble, and to petition the Government for redress of grievances.

1) Freedom of the Press and Speech

The introduction of a Trumpspeak⁵ component into the political dialogue is a high crime of the most criminal intent, since it is the criminal use of language to spread and legitimatize falsehoods in a spreading of non-investigative culture to confuse the “people” in their daily decision-making to rely on provable facts. ‘Trumpspeak’ is the mechanism of purposeful falsehood insertions for political gain in a construction of a totalitarian system of government and is accrued to its chief perpetrator, President Donald J. Trump. His trial and conviction are a necessary action of our representative government by the people and for the people in a contravention of this tyrannical system of government.

Trump and his gang of lackeys are having great success with their demonization campaign of the Press. Their strategy is a flood of news reports on all fronts, filled with ‘alternate facts’, forcing verification by overtime ‘vetting’ in the extreme, which necessitates a time constraining race to sift through ‘bogus’ false news events of questionable veracity. The sheer volume of this frenetic activity becomes an overwhelming multiple testing for the reporters already at a breaking point for their mental and physical endurance. Designed to overwhelm what he calls the “opponent press”, the men and women of the news gathering media have no other choice but to continue their work at a feverish pace on fact verifying sources in the traditional journalistic mode of truthful investigation. This important work is the dam holding back the floodwaters of catastrophe, which Trumpians threaten in their pursuit of anarchistic philosophies espoused to reorder [“repeal and replace”] our U.S. Constitutional system of Government.⁶

2) Freedom of Religion

He has a terrible record of prejudice for religions outside of the Christian Faith, displaying his contempt, on a regular basis, for the Moslem religion of the Koran. Trump has led us in two and one-half weeks to a constitutional crisis over refugee and immigrant status, one of the sacred hallmarks of our open policy to shelter the “huddled masses yearning to be free” through his misrepresentation of Islamic history and the precepts of the Koran’s religion and wisdoms.

His open preference for Christian Refugees in Moslem countries emigrating to the U.S. has caused widespread recognition of the diseased mental capacities of Mr. Trump when he falsely propagandizes Christians as murdered minorities in those countries. This shows intolerance for fact checking and his resort to Fox News and other questionable news outlets for his bogus facts. Trumpis, as a creature of the idiocracy, delegitimizes the framework provided for our generations into perpetuity.

Purposeful ignoring of the 1^st Amendment’s religious edict for a prohibition of a State Religion:

…no law respecting an establishment of religion…

This is a very important piece for the freedom of religion enshrined in the First Amendment of the Bill of Rights. It expressly prohibits the theocratic tendencies of European Christian Faith Churches from excreting their majority faith on the country to allow minority religious ideas a ‘freedom for all’. A state religion, chosen by the evangelistic sects, has been hatched over the last two decades to blend secular government with the dogma of church going fantasists. The dream of a State Religion to overturn the ‘so-called refuting Christianity’ Constitutional document exposing the atheism “blasphemy” in the Constitution’s secular refusal to express belief in God the Father, all powerful, punishing, loving, giver of forgiveness and grace for original sin; is, in their eyes, with the election of savior Trumpis – a vindication close at hand. The blessed promise of a loving God’s dominion on earth will be forefilled in their lifetimes.

3) Freedom of Assembly

The Dictator Trump has a huge problem with massive crowds in the streets, here in country and globally, especially with the polls stating their “popular” displeasure with Mr. Trump’s political philosophies. The masses huge number density is a direct affront to the authoritarian dictator and the Courts continued encouragement of protesting. His sights are concentrated on the Courts laxity and on a support of police state tactics to quell and discourage the First Amendment Right of Assembly. These displays of anger and displeasure with Trump’s promises unkempt can only grow in its intensity with the Republicans incompetency over Universal Health Care. The scenario for peaceful protest from the Trump supporters and the Libertarians will devolve into violence on a massive scale bringing Trump’s narcissistic injury to a breaking point. Police use of military style crowd control and continuing unrest will be harshly confronted with extreme methods not seen before in the United States. Incarcerations, detentions, and Marshal Law tactics will become commonplace environments for all economic strata neighborhoods lower, middle and wealthy. The Justice system will be suspended. Expect escalation to Militia [National Guard] levels of ‘crowd control’. There the story goes dark with heavy machines of weaponry deployed in a chaos of conflicting edicts from the Trumpis White House – Central Command. Will we allow this Robocop scenario of corporate avarice and greed rule our “We the people…” Democracy?

4) Freedom to Petition for redress of Grievances

The spillover to the Courts’ co-equal Constitutional balance is declared by the Trumpians as a Court system out of balance with partisan rulings. Therefore the Courts, in their eyes, are enemy “adversaries” resisting President Trump’s word and wisdom for the “safety of the Nation”; warranting and deserving of uncivilized, condemning behavior in word and deed. The treatment of the Judicial Branch of Government in concert with the fact finding press, are receiving the full brunt of Trump’s displeasure and are his ‘enemies of the state’ to be conquered. The co-equal branches of this Democracy are under attack from a mentally unstable narcissist who will soon, through his narcissistic injury becoming completely unhinged rendering him unfit for the official duties of President. Trump’s impatience for the details of office, will make working for him a torturous ride into hell and will eventual cause his staff to melt away incapable of withstanding his irrational diatribes for their insubordinations. A desperate teacher expresses her frustration with the dysfunction of lawmakers to cope with “common sense” solutions involving protection and safety in our schools. The anxiety in her voice has made clear the vein of discontent Donald J. Trump was able to mine for his election of “fear.” Imagine her surprise when Trump’s narcissistic injury complicates it further as the ‘corporate state’ accomplishes its’ coup?

“I could tell them that your thoughts and prayers are with us. I could tell them we have your deepest sympathies. But I am teaching a class on argument, instructing my students on the importance of facts. So instead I will tell them the truth: They have to be prepared to hide out of the line of fire, and I to fight for our survival, because you, our lawmakers, haven’t done your jobs. I will tell them that their rights, my rights, the rights of my 5-year-old, to attend school without fear of facing senseless slaughter by machine-gun fire, are not important to you, that we must be prepared to fight tooth and nail, stapler and whiteboard marker, because you refuse to fight the gun lobby in this country.” Oregon Community College teacher, Melissa Duclos

This story is an encapsulation of the ‘on the ground’ anxiety perpetrated by the defiant arrogance of a corrupted, powerful NRA lobby and the ‘pay for play’ mentally of the government in state and federal assemblies across the United States. This corruption to bypass “…establishment of Justice, insure domestic tranquility, provide for the common defense, promote the general welfare…” is the unraveling which leads great nations to their downfall.

5) Immigration and Refugees

Donald J. Trump ‘s vision of immigrant and refugee huddling is weakness, crime, racial inferiority, sexual perverts, creatures of sloth, losers, and sub-human. The 1^st Article, section 9 of the Constitution states:

The Migration or Importation of such Persons… the states now

existing shall think proper to admit, shall not be prohibited…

The founding principle of this country has always been the diversity of cultures to exercise their philosophies both secular and religious in our free democracy. We have always boasted of our diversity as a method for innovation and “seeking” prowess in research for encouragement of the sciences and technology. The Trumpian rhetoric surrounding our policies of immigration is profoundly disturbing and produces a wave of dissonance in the perception of American exceptualism These cannibalistic predatory Trumpian creatures are eroding our country’s bedrock of infinite compassion for those in a world suffering genocide and diaspora persecutions.

He has hurt the place of respect reserved for the United States and this will have its’ consequence. The first could be the markets and currency patterns, which have, ever since World War II, revolved around the fortunes of the United States making it an American Century. Trump is replacing rational respect for the greatest and most powerful country with an unmasked bully man-child bent on revenge for imagined wrongs threatening the world with annihilating Nuclear Force. The World’s ‘blowback’, in retaliation, will be loss of the US dollar as the world’s reserve currency. This action will devastate all and the blame will be brought to our doorstep with a Trumpian grin. Trump is causing irreparable damage to the republic. This is an impeachable offense to his oath of office.

V. TREASON

The President, Vice President and all civil officers of the United States, shall be removed from office on Impeachment for and conviction of, Treason, bribery, or other high crimes and misdemeanors.

This indictment is recognition of Treasonous behavior and its’ attack on the Constitution’s intellectual framework for being designed as civil law based on non-partisan investigation. An attack on this framework of law is the ‘act of an enemy’ of our democratic state. The leader of this movement is then to be labeled “an enemy of the state”. The added position of High lawgiver and protector of the constitution [in the oath] Donald Trump has enthroned an added epithet of “traitor”. He is a traitor of dangerous proportions continuing to erode our political dialogue with a culture of unchecked pronouncements, slander, policy corruption, foreign entanglements, a list of illogical misrepresentations fomenting confusion, anger, mistrust and bad will on a global scale.⁷ His Misdemeanors are entangled in a convoluted web of financial dealings, branding, hotel gambling, entertainment venues, and many other monopolistic enterprises for private or family gain. He has been involved in currency manipulations to the detriment of the United States for his corporate entities. He has bent laws foreign and domestic, to utilize foreign cheap labor outside of the United States to enslave nations of the third world, institutionalizing their suffering for his own hegemony in flagrant “offenses against the Law of Nations” excerpted from: Article I, section 8.

Trump is also the recipient of foreign largess from the Russian Federation. The cyber war around the falsehoods of his election Nov. 2016 involving his opponent Hilary Clinton, is in itself indictable for foreign entanglements including the Emolument clause of Article I, section 9. He is responsible for his aides/sycophants’ [advisor Flynn] foreign zealousness to overturn the Obama legacy of an intensely successful eight-year state department diplomatic effort. These illegal activities were premature negotiations with the Russian Federation and V. Putin over the Obama sanctions action specifically curbing Putin’s stratagems of Russian national protection learned at the knees of his KGB mentors. The sanctions are U.S.A. established policy markers with a great deal of concurrence from the Military Nuclear Complex. This qualified Putin as an adversarial enemy to which Trump was giving “aid and comfort” [Article III, section 3] even prior to election as President, against the wishes of the Union and earning Donald J. Trump the epithet: traitor of the Republic.

Treason against the United States, shall consist only in levying War against them [U.S.] or in adhering to their enemies, giving them Aid and Comfort.

VI. GRIEVANCES PERTAINING TO TYRANNY OF THOUGHT AND DEED BY

DONALD J. TRUMP

These grievances form a brief for the impeachment and trial of a dangerously psychotic personality now in the position of being the most powerful living person on planet Earth. How has a mentally deficient person of Trump’s depth been given the status and privilege of the most powerful person on the Planet? It is a confluence of unfortunate acts of history, which has brought mankind to this brink of annihilation.

It all points to a monumental apathy in our democracy borne of rich resources too plentiful to be curbed for the society’s gluttonous appetites. And so we have gouged beyond our better wisdom’s ‘common sense’, creating apathy in our judgment to keep vigilant for the creeping degradation of our nation’s moral fiber and basic human caring for each other. This is one of our greatest grievances in an ‘age of anxiety’. Our thoughts are being ruled by an unrelenting fear of our own demise through arrogance and sloth [laziness]. And we cannot see from ‘where?’ this ridiculous state of affairs emanates. Believe me – the intensifying fear is the work of Donald J. Trump. It is from within the body politic. He is the terrifying grievance against the American people, with his manufactured reality of divine power and inflated appraisal of his skills as a grade Z sales branding “businessman”.

It is a grievance against the Cosmic Hugeness. This is the time of false prophets foretold in the books of wisdom. Through the tiniest of openings, the evil ones have entered the house to spin their tales of impending doom; generating a fear for lost causes, while they loot as zombies, the wealth of nations for themselves, living by another set of Laws and principles.⁸

The irony of intellectual empathy, compassion and apathy⁹ has given birth to a monstrous agent of planet extinction in the land of the free and the brave which cannot be lost on those of its citizenry now cowering in corners and in denial to

a most horrifying event in the history of mankind. The 20^th century holocausts with their psychotic serial genocidal murderers¹⁰ rising to worldwide prominence should certainly provide the valuable lessons for future global survival through our own ingenious inventiveness. Here are excerpts from the Executive Article II.

The executive power shall be vested in a President of the United States of America. In case of the removal, Resignation, or inability to discharge the powers and duties of the paid office.

The president shall be commander in chief of the Army and Navy of the United States, and of the Militia Service of the United States… and he shall have power to grant reprieves and pardons for offenses against the United States; except in cases of Impeachment.

The President, Vice President and all civil officers of the United States, shall be removed from office on Impeachment for and conviction of, Treason, bribery, or other high crimes and misdemeanors.

Addendum for the Nuclear Weapons Responsibility in Article II: The Executive

Article II is devoted to the Chief Executive Officer or President of the United States of America. In its’ instructions we find no power for the creation of wars within country or in Nation States outside of country. Section 2, as I interpret, gives the President a military commander-in-chief status to have power over the army, navy and militia as a diplomat with forceful means in search peaceful outcomes in the reasoned quelling of “emotional” rationalizations leading to possible violence in words and deeds. This is in contradiction to the seemingly 21^st century command and control structure of our nuclear forces, which is now actually empowered to create wars through electronic means in “times of imminent danger”. This had been delegated to the “state under invasion” in Article I, section10 now transposed to the President’s singular power as commander-in-chief with his relationship to “Biscuit”.

According to the 1789 Constitution He is not empowered to make those fateful decisions of war and peace. In its original intent, the Constitution takes pains to circumscribe the awesome powers of the Executive, in ‘fear’ of a European repetition of divine ‘Kingly’ prerogatives not invested in this Office commensurate with duties of Presidential leadership for our [chamber music principled Three-branched] Democratic Republic. His, therefore, is a role of forceful diplomatic action to halt or retard hostile disagreements; often without this thoughtful intervention resulting in the tragic extremes of violent war. The President’s process of “thoughtful intervention” relies on a balanced incremental military response and treaties in negotiation authorized by Congress, hoping to find solution for the difficulties of grievances and disputes within and without the Nation. So, the carrying of Biscuit, which is connected to the nuclear codes by the ‘foot-ball’, is only empowered and legal with authority from the authorizing legislative ‘advise and consent’ of the Congress. Has Congress given that authorization? We do not have clear instructions on the dispensation of powers for the chief executive on this all-important matter. [I purpose the Fifth Branch of Government to make a new covenant for the awesome use and abuse of the planet killing potential of Nuclear Weapons. Need for another Article of instruction is necessary to be added to the Constitution, as illustrated with the advent of Donald J. Trump in his horrifying clarification.]

Postlude:

The rise of machines out of the ashes, they made, in World War II were held in such promising high regard and salvation for the 70 years following, only to be questioned in dreams of peril evoked by the coming of the anti-Christ Trumpis. We now face our possibly last and final test. Will the Trumpian overwhelm our rational

mind faculties? Will we see the moment of extinction in time to effect the survival expectation violation in an embrace of our vibratory health of chamber music harmony?

“Many cherished private hells were forever lost in those garrulous years and the vacuum each left was invariably filled with a boredom which, in its turn, could only be dispelled by faith. Remain optimistic. This may be the love, love, love of the Ancients in a trial by fire to be endured.
